شفافیت داده‌های اداری در نظام حقوقی ایران

چکیده
گسترش دولت الکترونیکی و افزایش نقش داده در تولید، پردازش و اجرای تصمیم‌های اداری، مفهوم شفافیت را از دسترسی سنتی به اسناد فراتر برده و انتشار پیش‌دستانه، کیفیت، قابلیت جست‌وجو، پردازش و استفاده مجدد از داده‌های اداری را نیز دربرگرفته است. اهمیت موضوع در نظام حقوقی ایران از آن جهت افزایش می‌یابد که داده‌های مربوط به بودجه، قراردادهای عمومی، معاملات، مجوزها، استخدام، عملکرد دستگاه‌ها و تصمیم‌های اداری، مستقیماً با حقوق شهروندان، نظارت عمومی، مبارزه با فساد و پاسخ‌گویی اداره ارتباط دارند. تصویب قانون مدیریت داده‌ها و اطلاعات ملی در سال ۱۴۰۱ و قانون شفافیت قوای سه‌گانه، دستگاه‌های اجرائی و سایر نهادها در سال ۱۴۰۳، چارچوب حقوقی جدیدی برای حکمرانی، تبادل و انتشار داده‌های اداری ایجاد نموده است. پرسش اصلی پژوهش آن است که نظام حقوقی ایران تا چه اندازه توانسته است میان الزام به شفافیت و انتشار داده‌های اداری از یک سو و ضرورت حمایت از حریم خصوصی، امنیت، محرمانگی و مالکیت فکری از سوی دیگر تعادل برقرار کند؟ فرضیه پژوهش آن است که قوانین جدید ایران ظرفیت مناسبی برای شکل‌دهی به نظام شفافیت داده‌های اداری فراهم کرده‌اند، اما پراکندگی مقررات، ابهام در حدود استثنائات، فقدان استاندارد واحد برای کیفیت و قالب انتشار و ضعف نظارت، مانع تحقق کامل این ظرفیت شده است. پژوهش حاضر با روش توصیفی ـ تحلیلی و رویکرد تطبیقی انجام پذیرفته است. برای پاسخ به پرسش پژوهش، قانون انتشار و دسترسی آزاد به اطلاعات، قانون مدیریت داده‌ها و اطلاعات ملی، قانون شفافیت سال ۱۴۰۳، قوانین و مقررات دولت الکترونیکی، قوانین مرتبط با امنیت و محرمانگی داده‌ها، مقررات اتحادیه اروپا، اسناد شورای اروپا، گزارش‌های رسمی داده‌های باز، آرای دادگاه اروپایی حقوق بشر و دیوان دادگستری اتحادیه اروپا و منابع دانشگاهی فارسی و غیرفارسی بررسی گردیده‌اند. یافته‌ها نشان می‌دهند که حق دسترسی به اطلاعات، به‌تنهایی برای تحقق شفافیت کافی نیست و باید با تکلیف انتشار پیش‌دستانه داده‌های دقیق و به‌روز، قالب‌های قابل پردازش، امکان استفاده مجدد، قابلیت انتساب و سازوکار مؤثر اعتراض همراه گردد. همچنین، داده‌های اداری زمانی می‌توانند ابزار پاسخ‌گویی عمومی باشند که منشأ تولید، مسئول به‌روزرسانی، روش گردآوری، تاریخ انتشار و حدود اعتبار آن‌ها روشن باشد. تحلیل حقوق ایران نشان می‌دهد که میان نظام تبادل داده میان دستگاه‌ها و انتشار عمومی اطلاعات، تفکیک کامل ایجاد نشده است. نتیجه پژوهش آن است که الگوی مطلوب شفافیت داده‌های اداری باید بر چهار رکن انتشار پیش‌دستانه، دسترسی به اطلاعات بر اساس درخواست اشخاص، استفاده مجدد و حمایت متناسب از داده‌های حساس استوار گردد. بر این اساس، ایجاد تعریف واحد از داده‌های اداری، تعیین سطوح دسترسی، تدوین فهرست داده‌های با ارزش عمومی، الزام به انتشار در قالب‌های استاندارد، توسعه ناشناس‌سازی، تعیین مسئول شفافیت در دستگاه‌ها، تقویت نظارت مستقل و تصویب قانون جامع حفاظت از داده‌های شخصی، پیشنهادهای اصلی پژوهش را تشکیل می‌دهند.

چکیده English

The expansion of electronic government and the growing role of data in producing, processing, and implementing administrative decisions have transformed transparency from a traditional right to inspect documents into a broader framework encompassing proactive disclosure, data quality, searchability, machine readability, and re-use. The importance of this issue in Iran has increased because budgetary information, public contracts, transactions, permits, recruitment records, institutional performance data, and administrative decisions directly affect citizens’ rights, public oversight, anti-corruption efforts, and administrative accountability. The enactment of the National Data and Information Management Law in 2022 and the Transparency of the Three Branches, Executive Bodies and Other Institutions Law in 2024 has introduced a new legal framework for the governance, exchange, and publication of administrative data. The main research question is to what extent the Iranian legal system has achieved a balance between the obligation to disclose administrative data and the need to protect privacy, security, confidentiality, and intellectual property. The hypothesis is that recent Iranian legislation has created a significant basis for an administrative data transparency regime, but fragmented rules, uncertainty concerning exceptions, the absence of uniform standards for data quality and publication formats, and weak oversight prevent the full realization of that potential. The research uses a descriptive-analytical method and a comparative approach. Iranian legislation on access to information, national data governance, institutional transparency, electronic government, data security, and confidentiality is examined alongside European Union instruments, Council of Europe documents, official open-data reports, judgments of the European Court of Human Rights and the Court of Justice of the European Union, and Persian and English academic literature. The findings demonstrate that a right of access to information alone cannot establish effective transparency. It must be accompanied by proactive disclosure, accurate and updated data, machine-readable formats, meaningful re-use, traceable responsibility, and effective review mechanisms. Administrative data can serve accountability only when its source, responsible authority, collection method, publication date, and reliability are identifiable. Iranian law also fails to draw a sufficiently clear line between inter-agency data exchange and public disclosure. The analysis further distinguishes legal access from technical availability, showing that a public file is not genuinely transparent when it cannot be understood, verified, compared, or reused by ordinary users and independent researchers. The article concludes that an appropriate model should rest on four interconnected pillars: proactive publication, request-based access, re-use, and proportionate protection of sensitive data. It therefore recommends unified definitions, clear access levels, a national catalogue of high-value public datasets, standardized publication, robust anonymisation, designated transparency officers, independent oversight, and adoption of comprehensive personal-data legislation.
