حکمرانی داده‌های الکترونیکی درمانی در اتحادیه اروپا

چکیده
حکمرانی داده‌های الکترونیکی درمانی به‌عنوان یکی از الزامات اساسی تحول دیجیتال در نظام‌های درمانی، تنظیم دسترسی، اشتراک‌گذاری، قابلیت همکاری، امنیت و استفاده از داده‌های درمانی را دربرمی‌گیرد. این پژوهش با این سؤال که «الگوی حکمرانی داده‌های الکترونیکی درمانی در اتحادیه اروپا بر چه مؤلفه‌هایی استوار است و چه ظرفیت‌هایی از این الگو می‌تواند برای ایران قابل استفاده باشد؟» به بررسی ساختار حکمرانی داده‌های الکترونیکی درمانی در اتحادیه اروپا می‌پردازد. با روش توصیفی و تحلیلی، مقررات و سازوکارهای حقوقی، فنی و نهادی اتحادیه اروپا، به‌ویژه مقررات فضای اروپایی داده‌های سلامت، مورد بررسی قرار می‌گیرند و در بخش پایانی، ظرفیت‌های این تجربه برای ایران مورد توجه قرار می‌یابد. یافته‌های پژوهش نشان می‌دهد که الگوی اروپایی بر ایجاد چارچوب مشترک حکمرانی، دسترسی و استفاده از داده در فرایند ارائه درمان، اشتراک‌گذاری و قابلیت همکاری، حفاظت از حقوق اشخاص و استفاده ثانویه از داده‌ها استوار است. انسجام میان قواعد، زیرساخت‌ها، استانداردهای مشترک و نهادهای مسئول، مهم‌ترین ویژگی این الگو را تشکیل می‌دهد. بررسی اجمالی ظرفیت‌های موجود در ایران نیز نشان می‌دهد که برخی زیرساخت‌ها و سازوکارهای مرتبط با داده‌های درمانی در کشور شکل گرفته‌اند و از این حیث، تجربه اتحادیه اروپا می‌تواند برای شناخت الزامات یک حکمرانی منسجم‌تر مورد استفاده قرار گیرد. بر این اساس، اهمیت تجربه اروپایی برای ایران بیش از انتقال مستقیم قواعد، در الگوی هماهنگ‌سازی ابعاد حقوقی، فنی و نهادی حکمرانی داده‌های الکترونیکی درمانی قرار دارد.

چکیده English

Governance of electronic treatment data, as an essential requirement of digital transformation in healthcare systems, encompasses the regulation of access, sharing, interoperability, security, and the use of treatment-related data. This study addresses the question: “What are the main components of the European Union model of electronic treatment data governance, and what capacities of this model may be relevant to Iran?” Using a descriptive-analytical method, the study examines the legal, technical, and institutional framework of electronic treatment data governance in the European Union, with particular emphasis on the European Health Data Space Regulation, while considering the potential relevance of this experience to Iran. The findings indicate that the European model is based on a common governance framework, access to and use of data in healthcare delivery, data sharing and interoperability, protection of individual rights, and secondary use of data. The integration of legal rules, infrastructures, common standards, and responsible institutions constitutes a central feature of this model. A brief consideration of the existing capacities in Iran also indicates that certain infrastructures and mechanisms relating to electronic treatment data have been developed. Accordingly, the European experience may provide a useful framework for understanding the requirements of more coherent data governance in Iran. The significance of the European model for Iran therefore lies less in the direct transfer of legal rules and more in its approach to coordinating the legal, technical, and institutional dimensions of electronic treatment data governance.
